DMCA Policy

The Listing Site LLC (“Company,” “we,” “us”) respects the intellectual property rights of others and complies with the Digital Millennium Copyright Act, 17 U.S.C. §512 (“DMCA”). This page explains how copyright owners can report alleged infringement and how affected users can respond.

Submitting a DMCA Notice

If you are a copyright owner (or authorized to act on behalf of one) and believe that material on our platform infringes your copyright, you may submit a written notice to the Designated Agent above. Your notice must include all of the following elements required by DMCA §512(c)(3):

  1. A physical or electronic signature of the person authorized to act on behalf of the copyright owner.
  2. Identification of the copyrighted work claimed to have been infringed, or a representative list if multiple works are involved.
  3. Identification of the material claimed to be infringing, with sufficient detail for us to locate it on our platform (e.g., URL or description).
  4. Your contact information: name, mailing address, telephone number, and email address.
  5. A statement that you have a good-faith belief that use of the material is not authorized by the copyright owner, its agent, or the law.
  6. A statement that the information in the notice is accurate, and under penalty of perjury, that you are authorized to act on behalf of the copyright owner.

Counter-Notice Procedure

If you believe that material you posted was removed or disabled as a result of mistake or misidentification, you may submit a written counter-notice to the Designated Agent. Your counter-notice must include:

  1. Your physical or electronic signature.
  2. Identification of the material that was removed or to which access was disabled, and the location where the material appeared before removal.
  3. A statement under penalty of perjury that you have a good-faith belief the material was removed or disabled as a result of mistake or misidentification.
  4. Your name, address, and telephone number, and a statement that you consent to the jurisdiction of the Federal District Court for the judicial district in which your address is located (or, if outside the United States, the Southern District of Ohio, Western Division), and that you will accept service of process from the person who provided the original notice or that person’s agent.

Put-Back Timeline

Upon receiving a valid counter-notice, we will forward it to the original complainant. If the complainant does not notify us within fourteen (14) business days that they have filed a court action to restrain the alleged infringer, we may restore the removed material.

Repeat-Infringer Policy

We will, in appropriate circumstances, terminate the accounts of users who are determined to be repeat infringers. We may also remove content and restrict access when we reasonably believe ongoing infringement is occurring.

Misrepresentation Warning

Under 17 U.S.C. §512(f), any person who knowingly materially misrepresents that material or activity is infringing, or that material was removed or disabled by mistake or misidentification, may be liable for damages, including costs and attorneys’ fees. Please consider whether the material at issue is actually infringing before submitting a notice.
